Surveillance and punishment in the age of disinformation

With the advent of informational disorder in contemporary times, there has been a need for institutions to create mechanisms to control misinformation. In this context, this study analyzes the control mechanism created by legal institutions to curb the informational disorder that has been established, aiming to restore the order of discourse. As a theoretical basis, we will use Michel Foucault's archaeo-genealogical method, which discusses the conditions of possibility for discourses and the power relations that shape them. We analyze discursive materialities that demonstrate the action of the power mechanism instituted by the STF (Supreme Federal Court) and the TSE (Superior Electoral Court). As a result, we reflect on the disciplinarization of subjects and discourses in today's society.
