Analysis about guidelines of the International Labor Organization for migrant worker and Brazilian infraconstitucional law

Abstract

The present paper addresses constitutional and infra-constitutional rights and guarantees for migrants in Brazil. The investigation intends to understand if this country follows the international guidelines related to human rights, migration policy and, particularly, labor guarantees to migrants. The research allows to confront national security and the fundamental rights and guarantees, through international legislation and guidelines, highlighting human dignity, in order to understand if inherent human rights are respected or if the state interests prevail, due to instability of state security and sovereignty when foreigners arrive in the country, with the evident result of a change in legislation to a humanitarian look regarding the migrant.
